摘要
20世纪二三十年代是我国刑法学的一个重要发展阶段,在"西法东渐"的过程中,德日刑法学的引进与西方犯罪学、刑事政策学的入华成了一时之特征,也造成了一定程度内的中西之争,在这些争论内,民国刑法学的集大成者蔡枢衡先生倡导的建设中国新概念法学,在时下中国现代刑法学吸收大陆法系刑法学的"化西"进程中仍有其不可忽视的参考价值。
The development in 1920s and 1930s is of great significance for Chinese academic research of criminal law. In the period of ＂eastward spread of western jurisprudence＂, the introduction of German - Japanese criminal law and western criminology, criminal policy are the distinct characteristics at that time; this has also brought on some arguments on Chinese - western culture to a certain extent. Considering such arguments, the most important theorist of criminal law in Republic of China, Mr. Cai Shuheng promoted the new concept jurisprudence in China, which still possesses a nonnegligible value for the assimilating of continental criminal law of modem academic study of Chinese criminal law.
