对职务犯罪案件审查逮捕程序改革的思考——兼评最高人民检察院“批捕提级”的《规定》

On Consummating the Method of Censorship and Arrest in Crime by Taking Advantage of Duty

我国职务犯罪案件审查逮捕程序一直面临着理论界的质疑和司法实践的困境。最高人民检察院已经决定将职务犯罪案件决定逮捕权上提一级,这对于优化犯罪嫌疑人的救济程序,强化职务犯罪案件审查决定逮捕权的外部监督,以确保决定逮捕权的正确履行意义重大,但如何在严格执行改革后的程序的同时,从观念上厘清认识,并采取相应配套措施加以完善则是一个不可回避的问题。

The present method of censorship and arrest in crime by taking advangate of duty now face the oppugn of the in theory and dilemma in judicatory practice. While maintaining the existing structure of lawsuit,the decision-making right shall be made by a superior section,the procedure of remedy for suspicion shall be perfected,and the supervision of the right to arrest in such cases shall be reinforced,in order to ensure the right be exercised properly.
