摘要
时值中国特色社会主义法律体系形成和完善的关键时期,通过对中国法律体系的构建从逻辑层面上进行深入分析,在综合考量"演绎建构主义"和"归纳进化主义"两种逻辑建构进路后,对中国法律体系建构过程中存在的问题进行了反思,并在此基础上,提出如何更好构建中国法律体系的设想,以期使中国特色社会主义法律体系更加科学和严谨。
It is now a critical time for China to form and perfect its socialistic legal system with Chinese characteristics. A deep analysis is made on the construction of the legal system in China from the aspect of logics, and by discussing the two logical construction paths including the ＂deductive constructivism＂ and the ＂inductive evolutionism＂, the authors discuss about the problems in the construction process of China＇ s legal system. Based on this, assumptions on how to better construct the legal system is proposed, with the purpose to make the system more scientific and precise.
