摘要
我国住宅小区贯彻业主自治原则。根据现有法律法规,实现业主自治的模式是"业主大会—业主委员会"的模式,但这一模式并不适应当下中国的实际,应运用代议制和分权制衡原理成立业主大会、业主代表大会、业主委员会和业主监督委员会等机构,并赋予相应的职权,由此形成"立业主大会—业主代表大会—业主委员会—业主监督委员会"的新模式。
The principle of owner autonomy is practiced in the residential community in our country. According to the law, the model of realization of the owner autonomy is the "owner congress-owner committee" model, but this model isn't suitable for the present situation in China: It should be reconstructed under the principle of the representative system and separation of powers and theirs checks and balances to form a new one, that is, the "owner congressowner representative convention -owner committee- intendance committee" model.
