摘要
2008年5月12日汶川大地震发生后,对于灾区民众在房屋毁损灭失后,剩余部分按揭贷款究竟应当如何处理,现行法律、政策和保险制度陷入了困境。本文通过对情事变更原则的理论分析,指出应借鉴国外民法制度中的这一原则解决房贷难题,并提出了司法实务中操作的具体思路。
After the major earthquake in Wenchuan,the current law,policy and insurance system are in dilemma at how to deal with the rest mortgage loan after the residential building collapsed.At first,the thesis theoretically analyzes the principle of contract situation variation.Then,it is proposed that the principle of contract situation variation should be adopted to solve the problem.At last,the author advises how to operate in juridical practice.
