完善我国司法鉴定制度的几点思考

司法鉴定是保证司法公正的重要一环,提高司法鉴定的质量关键依靠制度。司法鉴定活动应符合一系列程序正义的基本理念,即当事人平等、鉴定程序公开、诉讼各方对程序的平等参与等各个方面。笔者从我国司法鉴定制度应树立和谐的理念出发,分析司法鉴定制度的现状及存在的问题,并从几个方面予以完善:司法鉴定程序的启动机制,司法鉴定行业级别制度和统一的司法鉴定标准,鉴定人出庭质证的制度,鉴定人员的资格确认。

Identification of Justice is an important element to ensure justice and its quality depends on system. Identification of the activities of the administration of justice should be consistent with the basic idea such as a party of equality, identification procedures for the public, equal participation in all aspects. From the concept of harmony, the author analyses its current situation and problems and the ways of how to improve it.
