摘要
在全球高度重视可持续发展的时代背景下,跨国公司的环境法律责任问题引起了广泛关注,尤其在跨国公司的子公司不能完全承担对东道主国家造成的环境法律责任的情况下,追究母公司的责任就引发了人们的思考。就此问题,本文主要从母公司承担环境法律责任的现行法律障碍、突破障碍的相关理论及公司法人人格否认理论的实践适用进行论证,以期缩小跨国公司转移污染产业对我国环境的不利影响,为完善跨国公司环境法律责任的规制提出立法建议。
In the period of stressing sustainable development in the world, environmental legal liability of transnational corporations has been paid great attention. Whether holding companies should be charged or not is a question worthy of consideration when their subsidiaries are unable to be responsible for the environmental legal obligation in host country. In order to solve the problem, the thesis mainly discusses the handicap in active laws and relevant reasonable solutions and the application of the principle of person responsibility of corporate juridical to reduce adverse effect about pollution industry transferred by international corporations and propose the suggestions for bettering legislation in the area.
