社会转型期的警察权配置研究

一个社会的警察权配置是由这个社会在进行社会控制时的价值取向所决定的,即公共秩序价值和个人自由价值的选择。秩序和自由不仅是一种对立关系,还应当是一种动态平衡下的统一关系。在社会转型期,秩序和自由的冲突更加剧烈,因而两者平衡和统一的任务也更为艰巨。必须选择并采取那些能够最大限度地尊重和保障自由的秩序维护方式,使公民自由受到最小的限制;在维护自由价值时,必须为公权力保留最起码的能够有效维护和控制秩序的权力。社会转型对警察权配置提出了总体上的要求:应当对警察权加以控制,而不是简单地削减警察权的行使范围。其具体实施方式是:应当以维护秩序的最低需要为标准调整警察权力的范围,以自由价值的满足为出发点控制警察权。但是,为使警察权得以良好、有效地运行,因而当前应当注重警察权威的塑造。

Allocation of police power of a society depends on the value orientation in the social control, that is the choice of value of public order and individual freedom. Order and freedom is not only a antagonistic relationship, but also a dynamic balance under the unity. In the period of social transition, their conflict is more intense, so the balanced and integrated tasks are more difficult. We must take measures free order at maximum to make sure the the minimization of the restrictions on civil liberty that respect and protect ~ In maintaining freedom value, we must reserve powers that can efficiently maintain and control order for public power. There is an overall request for allocation of police power in the period of social transition： controlling police power, rather than simply reduce its scope of exercises. There are ways to implement in detail： adjusting the scope of police powers with the standard of the minimum requirements to maintain order and meeting freedom value as a starting point to control police power. However, we should focus on shaping the police authority at present to enable the police power to be run well and efficiently.
