法治政府的应有之义——略论我国政府权力的制约

Due Righteousness of a Law-based Government——A brief review of the government power constraint in China

法治政府的建设是一项极其艰巨的系统工程,其中一项不可或缺的重要任务就是对政府及其权力实行严格的监督与制约,以维护行政权的正确合法行使和公民基本权利的实现。文章在考察并借鉴西方发达国家对政府权力实行制约的理念、主要形式及内容的基础上,针对我国正在加快建设社会主义法治国家及其法治政府的特殊国情,结合中国特色的政治体制,分别从内部制约和外部制约两个基本维度,提出了对我国政府权力实行有效制约的基本思路和实现途径。

The law based Government＇s construction is an extremely difficult systematic engineering, in which an integral and important task is to impose strict supervision and restriction on the government and its power in order to safeguard the legitimate right to exercise executive power and the achievement of the citizen＇s fundamental rights. By investigating and drawing lessons from the ideas, major form and content of power constraints of the government of the western developed countries. Aiming at China＇s specific national conditions of accelerating the building of a socialist law based country and its law-based government, in combination with the political system with Chinese characteristics, the paper respectively proposes the basic ideas and approaches to implement effective constraints on the government from the perspective of the intrinsic and extrinsic constraints.
