摘要
新法施行时对以前发生但尚在持续的事实或法律关系如何处理,是立法者始终面对的过渡问题,解决不当会严重影响法的实效和权威。大规模的规避《劳动合同法》的行为便是其典型例证。对此问题的解决,有赖于对法的稳定性、信赖利益保护与法的正义性、公共利益促进这两类对立性因素加以权衡,并采用恰当的过渡方式。过渡方法必须根据具体过渡事宜来确定,其选择应有助于实现优先保护的利益并使其与新法目的相协调。
How to deal with continuing actions happened before new law coming into effect and legal relations formed by old law is the transitional problems faced always by legislators.The actual effect and authority of law will be damaged seriously if transitional problems are not resolved suitably.The evasion of Labor Contract Law of the People s Republic of China may be a good example.Legislators should give adequate balance to reliance interests,legal stability,social justice and public interests in making transitional provisions. The choice of transitional meehanisms should base on nature of transitional issues, and be in compliance with the prompting of superior interests and the realization of new law aim.
