摘要
调解人主持调解的过程也是实施干预的过程,可以是对调解过程、实体内容或调解结果的干预,也可以表现为积极干预或消极干预。干预的强度主要与当事人心理、调解人身份、纠纷性质、纠纷涉及公益的程度以及调解程序设计等因素有关。适度干预的策略主要包括设定合理的干预界限、寻找合理的干预方法、加强对调解人行为的约束机制、建立诉讼内调审分离机制以及变更纠纷解决方式等。
The process that mediator conduct a mediation is also a process that mediator intervene the mediation.Mediator can intervene over the process,substance or outcome of mediation and it can be divided into positive intervention and negative intervention.The extension of the intervention is influenced by the psychology of parties,mediator s degree,the nature of the dispute,the degree of the dispute involving public interests,and the design of mediation process,etc.There are a lot of strategies that how to intervene a mediation appropriately, that is drawing a rational line, finding sound methods, enhancing the regulation of mediator's conducts, building the separating system between mediation and trial, and changing the dispute resolution, etc.
