论我国人民调解制度的改造

On Reconstruction of China’s People Mediation System

对我国传统的人民调解制度进行改造,首先必须确定人民调解的功能,人民调解制度仅仅是诉讼外解决民事纠纷的一种机制,明确了这一定位,对人民调解的改造即应着力于加强其解决民事纠纷的能力,包括应将人民调解组织改造成专业性的民事调解法定机构,根据城乡不同情况和需求,建立城乡二元化的调解组织和制度,并建立诉讼外民事调解与法院审判的有机链接,以提升调解协议的效力。

For the reconstruction of China＇s traditional people mediation system, the first thing to be made clear is the function of the people mediation system, that is, a system resolving civil disputes through civil mediation. Knowing this point, the reconstruction of the people mediation should lay its emphasis on the strengthening of civil disputes solving function, including reconstructing the people mediation institute into professional legitimate institute of civil mediation, establishing the dual urban and rural mediation institute and system based on different conditions and demands of urban and rural conditions as well as building organic link between civil mediation and court judicial, so as to increase the efficacy of mediation contract.
