摘要
我国目前的节能监管实行的是统一监督管理和有关部门结合各自职责进行分管相结合的一种监督管理体制。该体制对于加强节能管理、促进合理使用能源等方面起到了一定的作用。2008年施行的新修订的《节约能源法》并未明确专门的监管机构和相应的职权职责以及保障机制和执行程序,有关法条不够严细和明确,存在着节能工作监管难、执法难、问责难等问题。随着我国经济的快速发展,能源需求增加,能源利用效率低和由此造成的环境污染加剧等问题日益突现,建议应当完善《节约能源法》,严格节能监管制度,进一步强化政策激励,明确节能管理机构和节能执法主体并加大违法惩戒力度。调动全社会的力量,走政府监管与社会监督相结合的道路。
China's energy saving separate management by individual regulation system is a blend of unified supervision and management and regulatory authorities.The system has played an important role in strengthening energy saving management and promoting the rational use of energy resources.The modified Energy Conservation Law of the People's Republic of China,which became effective in 2008,does not specify the specialized agency for supervising energy conservation or defines the corresponding duties and responsibilities of different departments.It does not set out the relevant guarantee mechanism or enforcement procedures for energy saving either.In addition,as some clauses of the law are not clear enough,enforcers often meet difficulty in regulating work,enforcing laws and seeking measures of blame for wrongdoing.Generated by rapid economic growth,China's energy demand is on the rise and as the country's overall energy efficiency is low, environmental problems such as deteriorating pollution have increasingly come into sharp focus.This article calls on the government to perfect the Energy Conservation Law and energy saving supervision system,offer more policy incentives,clearly define the authority and responsibilities of energy saving regulatory bodies and law enforcers,strengthen its effort to punish regulation violation and mobilize the entire society to build an energy saving regulatory system combining governmental regulation and public supervision.
