On Priority of Local Legislative Power

地方先行立法权是我国《立法法》第64条第2款赋予地方立法机关的一项权力,具有创新性、从属性、试验性和效率性等特征。地方先行立法权的行使必须满足主体适格、范围特定和条件成熟三项要件。针对地方先行立法权行使可能造成的危害,我国应从时间、内容、程序三个方面对其予以规制。

Priority of local legislative power is the local legislature s power that come from provisions of Legislative Law Article 64,Paragraph 2 in China.It have innovative,secondary,experimental and efficiency characteristics.The exercise of power must be adequate to meet three specific elements,including proper subject,specific scope and mature conditions.We should regulate the priority of local legislative power from time,content,and procedures in order to avoid the possible harm caused by it.
