论土地使用权市场化流转视角下地方政府非公益土地征用职能的转变

Function Transformation of Local Government Non-public Interest Land Acquisition under Land Use Rights Marketability Perspective

利用文献资料法、实证分析法、因果分析法等方法,对非公益土地征用中地方政府的职能定位进行了研究。结果表明,地方政府参与非公益土地征用是因为非公益土地征用对其有着巨大的利益诱惑,在许多地方,土地出让金收入正演变为地方政府的第二财政;在非公益土地征用过程中,地方政府存在着严重的职能错位、越位和缺位;重新定位了地方政府非公益土地征用职能,并指出地方政府在非公共利益土地征用中的职能应向管理者、提供者、监督者、协调者职能转变,这是维护土地市场健康发展和保护失地农民根本权益的有效途径。

The purpose of this study is to set up function localization of local government in the non-public interest land acqusition process. Methods of documentation, causality, and positive analysis were employed. The results indicate that the local government participation in non-public interest land acqusition is attracted by the huge benefit of the non-public interest land acqusition and in many places the land fees from sales income is evolving the local authority＇ s second finance. In the non-public interest land acqusition process, the Local authority has the serious funtion＇ s dislocation, the offside and the vacancy and relocates the local government functions of the non-public land acquisition. The conclusion of the study is that the functions of land acquisition of local government in non-public interest should be managers, providers, supervisors, coordinator functions in order to maintain the healthy development of the land market and protect the interests of land-lost farmers. This is an efficient path to maintain the healthy development of the land market and protect the interests of land-lost farmers.
