对社会法的理论基础与制度构建的设想

The Idea on the Theoretical Basis and the System Building of Social Law

为论证社会法其独立法律部门的地位与现实可行性,从政治高度入手,找寻到其产生、存在与发展的经济基础与社会基础。在理论基础层面上,用社会责任本位来定位社会法,并通过公平责任理论和倾斜保护理论手段,以实现全社会的整体公平;社会法制度构建方面,从社会法的调整对象引申出其主体制度,将其具体调整内容划分为倾斜保护性质的社会法,社会保障性质的社会法与社会公益性质的社会法等,并阐述了其特有的责任制度,以期对当前日益凸显的民生问题的解决找到有力的法律支持。

From the perspective of the politics, the writer of this paper tries to verify the independent legal status and feasibility of social law by seeking for the economic and social infrastructure for its source, existence and development. On the basis of the theoretical level, the writer defines the social law with social responsibilities to achieve a goal of a fair society as a whole by means of the fair responsibility theory and the tilt protection theory. In the aspect of the construction of the specific social system, the subject system extends from the object of social law which includes social laws of tilt protection, social security and social welfare. The writer expounds its unique responsibility system in order to find an effective legal solution to the current issue of the people livelihood that has become increasingly prominent.
