摘要
网络实名制自2003年首次提出后一直在以各种方式尝试推行,但收效甚微。今年5月《杭州市计算机信息网络安全保护管理条例》的颁行再次将网络实名制拉回公众视野,并引发了一场争议。支持者认为网络实名制能够更好地保障人权;反对者则认为恰好相反,它对人权的侵犯大于保护。然而,综观这十余年的实践经验可以看出,由于立法和救济的双重缺失,网络实名制在我国至少目前尚不具备全面推行的条件。借鉴国外经验,转变政府管理思维或许能为网络实名制的真正推行找到出路。
Since the network real name was put forward in 2003, it has been tried to put into effect, but the result is unrewarding. In May of this year, The Administrative Regulations of Hangzhou Computer Information Security Protection took it back again to the public view, and triggered a massive dispute. Supporters think it better way to safeguard human rights, while opponents argue the contrary: it means more violation than protection of hu- man rights. However, the 10 years practical experience shows that, due to the lack of legislation and relief system, the network real name still does not have comprehensive conditions in China at least currently. The only method to find a way out is to draw lessons from abroad, and change government management system.
