论行政自由裁量权的司法审查

行政自由裁量权有其存在的必要性,但如果行政自由裁量权在运行过程中因缺乏合理控制而导致滥用,势必会造成侵害行政相对人合法权益的不利后果。因此,加强对行政自由裁量权的控制以防止其滥用是十分必要的。实践表明,通过司法审查来控制行政自由裁量权以实现保障行政相对人合法权益的目的将是切实可行的有效途径。

The administrative discretion have the necessity of its existence, but if the administrative discretion that in operation lack the reasonable control and lead to abuse, it will cause adverse consequences of aggrieving the legitimate rights of administrative relative person inevitably. It is very essential to strengthen the control of the administrative discretion to prevent its abuse. Practice shows that it is a feasible and efficient way that using judicial examination to control the administrative discretion to achieve the purpose of protecting the legitimate rights of safeguarding administrative relative person.
