On the Function of Economic Law——Based on the Criticism of the Existing Function Research of Economic Law

目前学界对经济法功能的研究明显少于对其他经济法基础理论的探讨,对经济法功能研究的推进有助于深化对经济法本质的认识。通过对经济法功能已有研究的梳理,参照经济法功能认识的方法和路径,现有的对经济法功能的认识有待进一步澄清和展开。经济法功能的框架搭建首先应考虑其层次性,即总功能和次级功能及再次级功能的划分;同时,对经济法功能的具体描述也是必不可少的。

Currently, the academic study of the function of economic law is significantly less than that of other basic theories of economic law. The promotion of the study about the function of economic law will help deepen the understanding of the nature of economic law. Combing existing researches on the function of economic law and con- suiting the method and path used with regard to the recognition of the function of economic law, we believe that the current understanding of the function of economic law should be further clarified and expanded. To build the framework of the function of economic law, consideration about its hierarchy, the division of general function, the secondary and the further subordinate functions, comes first. Furthermore, specific description of the function of economic law is also essential.
