The Measures at Issue in WTO Dispute Settlement Procedures

摘要 系争措施的确定决定着专家组职权范围的确定,是专家组程序进入实体审理之前需要解决的先决问题。成为系争措施需满足以下条件:须为政府采取或参与的措施,须在设立专家组请求书中指明。系争措施不应根据起诉方所主张的该措施所违反的具体WTO义务来确定。设立专家组请求书中使用的"包括但不限于"一词,不能把请求书中没有明确列出的措施纳入专家组职权范围。系争措施原则上为专家组成立时存在的措施,但也有例外。要区分设立专家组请求书中支持起诉方诉求的论据与系争措施。 A panel＇s terms of reference are decided by the identification of the ＂measures at issue＂. The identification of the ＂measures at issue＂ is a threshold issue before a panel examines the substantive issue. The measures at issue should meet the following conditions： they are measures taken by a government or a government joining in, and they should be stated in the petition for the establishment of a panel. The measures at issue should not be decided according to the specific WTO obligations violated by the measures. The wording of ＂including but not limiting to＂ in the petition can＇t bring the measures not clearly set out in the petition into a panel＇s terms of reference. The measures at issue are existing measures at the time of establishing the panel in principle, but there are exceptions. The measures at issue are different from the applicant＇s arguments supporting his request in the petition.
