政府采购国际化的法经济学分析

Study on the Law Economics of Government Procurement Internationalization

政府采购是国家财政支出的重要手段之一,政府采购法是财政法的重要组成部分。随着经济全球化日益加深,政府采购国际化趋势明显,但是国内法和国际法中都没有给出明确的评价政府采购国际化的标准和原则。从法经济学的视角,分析政府采购的显性直接影响和隐性的间接影响,得出一个较为合理的衡量政府采购国际化的标准和原则,进而提出了相关的政策建议。

Government procurement is one of the means of national financial expenditure.The Government Procurement Law is an important part of the financial sector.With the deepening of economic globalization,the international trend of government procurement becomes obvious,but domestic and international law haven′t give a clear evaluation of the government procurement of international standards and principles.From the perspective of law and economics,this paper gives an analysis of the direct explicit and indirect implicit impact of government procurement.It is attempted to give a more reasonable measures for judging the international standards and principles of government procurement.Some policy proposals are put forward.
