劳动者物质性人格权的法律保护

On Legal Protection of Laborers’ Substantial Right of Personality

物质性人格权是劳动者享有的一项基本权利。确立物质性人格权有助于加强劳动者生命权、健康权和身体权的法律保护。由于立法、执法的不足以及劳资双方力量的不平等,目前我国劳动者物质性人格权受侵害的现象相当严重。因此,必须加强劳动者物质性人格权的立法和执法工作,提高劳动者的自身素质和维权能力,同时建立劳动公益诉讼制度。

The substantial fight of personality is a basic fight to the laborers. To establish the substantial fight of personality is beneficial to the legal protection of the fight of life, the fight of health and the fight of body to the labor. Due to insufficiency of legislation and administration of justice, the inequality of power between the employer and the laborer, the laborers＂ substantial fights of personality have been injured seriously. So we have to strengthen the legislation and the administration of justice, improve the quality and ability of the laborer, establish the labor public welfare litigation.
