我国突发性水污染事件生态补偿立法问题的研究

近年来,我国发生了多起突发性水污染事件,造成了严重的生态灾难。对这些事件进行生态补偿是对生态环境恢复、维护社会稳定及和谐的必要手段,但我国法律对该类事件的生态补偿规定并不明确。本文分析了突发性水污染事件的特点和我国现行法律制度中对突发性水污染事件的生态补偿规定存在的问题,进而提出了建立突发性水污染事件生态补偿机制的立法构想。

Our country has taken place several sudden water pollution accidents in recent years. Ecological compensation is a effective way to recover ecosystem and environment, and it can compensate losing of society and economy. But law of our country is ambiguous to the ecological compensation . So this paper analyze characteristic of sudden water pollution accident, and discuss the problem of ecological compensation legislation of sudden water pollution accident in our country. According to this analysis, we educe the proposition of ecological compensation legislation of sudden water pollution accident in our country.
