摘要
《中华人民共和国食品安全法》已由全国人大常委会表决通过,并已于2009年6月1日实施。这是我国食品安全领域首部统一的法律,虽然仍依稀可见《中华人民共和国食品卫生法》的痕迹,但它是一部全新的法律,汇集了学术界和实务界众多专家和学者的智慧,在广泛征求社会各界的意见基础上完成,引入了诸多国内、外先进的立法与执法经验,为我国的食品安全监管提供了有力的法律依据。这部法律有许多亮点,但因我国的食品安全形势复杂,一部新生的法律难以完全解决,其尚存在一些不足和欠缺。
Food Safety Law was adopted and promulgated by the Standing Committee of the 1 lth National People' s Congress of the People' s Republic of China and has come into force at June 1,2009. It is the first unified law about food safety in our country and it is a brand-new one although some trace of "Food Sanitation Law" can be faintly visible in it. It has collected the wisdom of numerous experts and scholars in academic and practical realm and been completed on the foundation of opinions from the whole society. It absorbs much domestic and foreign experience of legislation and enforcement and will be a powerful legal basis for food safety supervision in our country. There are many highlights in the law while it still has some insufficiencies for the complex situation of food safety in our country.
