澳大利亚事实伴侣无遗嘱继承制度及其对我国之启示

De facto no-will succession system in Australia and its enlightening significance to China

澳大利亚各州和地区继承法意义上的配偶包括法定配偶与事实伴侣。各州和地区肯定了在法定情形下事实伴侣的继承权,公正地保护了事实伴侣的继承利益。建议我国借鉴澳大利亚的立法,赋予符合条件的事实配偶一定的继承权,对事实配偶的继承利益给予公正之保护。

According to the succession law in different states and areas of Australia, spouse includes both legal spouse and de facto spouse. All states and areas affirm de facto＇ s right of succession in legal circumstances and fairly protect de facto＇ s succession interests. It is suggested that de facto spouses who size up legal conditions be endowed certain right of succession and their succession interests be fairly protected by taking Australian legislation for reference.
