中国增设社区服务刑之必要性及立法构想

On the Necessity of Community Service Legislation and Some Legislative Designs

在我国现有刑种中增设社区服务刑,不仅能解决社区矫正试点过程中推行的公益劳动制度化和合法化难题,最大限度实现同罪同罚,而且有利于犯罪人顺利再社会化及融入社会,同时有助于平衡监禁刑与非监禁刑的轻重程度。文中并对社区服务刑的立法形式、适用条件及其服刑时间、内容和场所等进行了初步设计。

Adding the community service in China＇s legislation not only helps solve the problem of legalizing public welfare labor and implementing the criminal policy of ＂identical crime and identical punishment＂, but also brings the criminal into the process of re-socialization and, therefore, balancing the degree between imprisonment and non-imprisonment penalty. The paper is an attempt to design the format, application criteria, imprisonment terms, content, locale, etc, in community service legislation.
