无论是证据关联性的界定还是判定,都应当立足证据的基本功能是证明的根据。证据关联性包括形式关联和实质关联两个层次,它们分别影响着证据资格和证明价值。证据关联性的判定依据其自身是直接证据还是间接证据而有不同的方法,基本的规则体现为现代自由心证。

Both definition and determination on relevance of evidence must be based on the basic function of evidence. The relevance comprises two sub-levels-formal relevance and substantial relevance, which respectively affects the competency and value of evidence. Different methods are employed to determine the relevance depending on whether the evidence is direct or indirect and the basic rule is modern principle of discretional evidence.
