质疑中国人民陪审员制的设立原则

Querying the Principle of People Jury System in China

人民陪审制度的设立在扩大诉讼民主、发现案件真实、实现诉讼公正等方面发挥了重要的作用。然而,在世界范围内陪审制却不同程度地衰落,在中国,随着立法的完善,人民陪审制得到进一步发展。然而,人民陪审员制度的发展的方向似乎并不明确,坚持民主化方向还是提高其专业化程度成为必须解决的一个关键问题。无论从理论上还是在实践中,该制度已经遭到了越来越多的质疑,为了使一项制定初衷良好的制度不变成鸡肋,妥善解决好该项制度与法律原则之间的矛盾是当务之急。

People Jury System plays an important role in expanding judicial democracy, finding the case truth and realizing legal justice. However, this system tends to decline slightly all over the world, and this system needs further improvement in China. However people jury system has lost its direction, which is either sticking to democracy or insisting on specialty. Both in theory and in practice, the system has more and more questions, in order to not let this good system be in a dilemma, so that it is urgent to properly resolve the contradiction between this system and the other rules.
