On the Issues of Chinese Athletes Registration Management

研究目的:对我国运动员注册管理的相关问题进行探讨。研究方法:法律文本分析方法。研究结果和结论:我国运动员注册管理的主体是单项体育协会而不是运动项目管理中心,相关规范性文件将单项体育协会与运动项目管理中心相混淆的做法违反了《体育法》的规定。运动员注册管理行为的性质属于协会自治行为而不是行政行为,运动员注册管理争议属于民事争议而不是行政争议,运动员注册管理争议应当保留司法最终解决途径。

This research goal is to research the issues of Chinese athlete registration management and we take the legal text analysis method to achieve it.We can draw the conclusions that Chinese athlete registration management bodies are National Athletic Event Associations instead of National Sport Management Centers,some regulatory documents confuse the meanings of the two concepts and violate Sports Law.The nature of registration belongs to the autonomy act of associations rather than the administrative act.The disputes of registration are civil disputes and not belong to administrative disputes.Judicial final settlement should be retained for the disputes of registration.
