新旧《残疾人保障法》中有关体育相关规定之研究

A Comparative Study between the New Law of the Disabled Protection and the Former on the Clauses Related to the Disabled Sports

新残疾人保障法与旧残疾人保障法相比整体有了不少的进步,其中进步较大的是残疾人体育的相关规定——不但体现了爱残、助残、惠残、权利为先的立法指导理念,扩充了违法者的法律责任,增设了无障碍设施环境,而且有了一定的保障落实措施;但新残疾人保障法中残疾人体育相关规定仍然有不少地方需要进一步探讨。

Compared with the former law of the disabled protection, the new law has made a lot of progress in general. Particularly, there have been more steps forward on the clauses related to the disabled sports：which mainly rests on the guiding legislation notions of “taking care of the disabled, assisting the disabled, benefitting the disabled and rights coming first”. The new law expands the liability assumed by law breakers and stipulates that non - barrier facilities should be set up for the disabled and some measures have been taken to protect their rights. However, some regulations of the new law related to the disabled sports still have many points to be further discussed over.
