从《东盟宪章》看“东盟方式”的维护与转型

The Maintenance and Transition of ASEAN Way in the Perspective of ASEAN Charter

本文以《东盟宪章》出台之前的背景以及《东盟宪章》自身的内容为研究对象,认为"东盟方式"正经历一场适应新形势的转型,除了维护东盟方式中的部分原则外,更重视"第二轨道"作用和"国家内部关系"规范,侧重向"机构健全、功能强化"和向"高效的法制化"转变。

Inspecting into the background before the introduction of ASEAN charter and its content, this article points out the changes of ASEAN way in the new era of regional cooperation. In addition to maintaining the old principles, ASEAN way has been undergoing a transformation adapting to the new situation. More emphasis is paid on the second track and intra-state principles and norms that ASEAN countries abides by. Organizational capacity is strengthened and more legally efficient by building a sound body.
