在廉政制度设计中引入道德规范体系的思考

The Introduction of the Ethical System to the Design of the Clean Institution

制度反腐的重要性勿庸置疑。但制度拘于其自身的性质和特色,对某些领域腐败的治理亦存在一定程度的限制。历史经验表明,道德在预防腐败行为滋生和蔓延以及惩治腐败上都起着重要作用。对道德予以规范化是当今世界不少国家加强官员道德规范的举措。因此,应借鉴国外的先进经验,在廉政制度设计中引进公职人员的伦理道德规范体系,并为行政道德发挥作用提供环境支持,充分发挥道德的调节和约束作用,形成反腐防腐的内在动力,把道德的功能同法律的权威有机地结合起来,实现标本兼治,综合治理,促进权力运行机制的健康发展。

Institutional counter-corruption is of great importance. However, because of the characteristics of the institution, the counter-corruption in some fields is restricted. According to historical experience, ethics played an important role in preventing and punishing corruption. Many countries strengthen officials＇ ethics by normalizing ethics. Therefore, we should learn from foreign countries＇ experience, introducing public officials＇ ethics system to the design of the clean institution, so that we can display fully the moral adjustment and restraint function, forming the intrinsic power in counter-corruption and corruption prevention. We should integrate the moral function and legal authority to treat the symptoms and the causes, realize comprehensive program of public order, and promote the sound development of power operation mechanism.
