正义是在政治、法律、道德等领域中关于是非、善恶的肯定判断。人们的行为是否符合历史发展规律和最大多数民众的根本利益,是判断人们行为是否符合正义的客观标准。具体语境中的法律正义与社会正义常常不是融汇贯通的。司法实践中,具有法律安定性的法律正义与演变中的社会正义不断产生冲突和悖反。社会变迁中的正义冲突只能通过法律适用来解决。

Justice is the affirmative judgment about what is good and evil and what is right and wrong in the field of politics, law, ethics, etc. Whether people＇s activities coincide with the laws of historical development and the fundamental interest of the vast majority of the people is the objective criterion to judge whether the activities coincide with justice. The legal justice and the social justice are often not harmonious in the specific context. The legal justice that it has legal stability is always conflicting and paradoxical with the evolving social justice. The conflict of justice in the changing society can be resolved only through the application of the law.
