中国建立行政判例法制度的价值分析

The Value Analysis of Establishing Law Legal System of Administrative Case in China

英美法系和大陆法系日趋融合是法律文化发展的趋势。中国作为制定法国家,目前在行政法上存在概念难以界定、法律规定不明确,公民的行政法制观念不强,行政权与司法权失衡等问题。行政判例制度的引入对于加强中国公民法制观念,弥补成文法及其司法解释的不足,纠正行政权与司法权的失衡以及适应与国际接轨的需要等方面具有积极意义。

It＇s a tendency of the development of the legal culture that the two largest legal systems are integrating to each other. It＇s essential for our country to accept the administrative case legal system. This article try to demonstrate the important role of the establishment of the administrative case legal system in our country from four aspects as follows： the administrative case legal system can improve the notion of our citizen, the administrative case legal system can make up for the defects of the status and its interpretation; correct the unbalance between the administrative power and the jurisdiction and meet the demand of bringing China＇s law more in line with international practice.
