The Success and Contribution of New China in the Area of Ocean Law and Policy

新中国成立后,我国根据国际习惯、《联合国海洋法公约》和其他海洋制度规范,制定和实施了有关海洋问题的政策和法制,初步构建了我国海洋法制体系和政策制度,在海洋领域取得了可喜的成就。本文系统论述了新中国成立后在海洋政策与法制上的成就,同时,指出了我国面临的主要海洋问题以及解决思路,分析了我国开发利用海洋的必要性和可行性。最后,剖析了我国提出和谐海洋理念的国际法内涵,并提出了完善海洋政策与法制的对策建议。

After the foundation of the P.R.C,the relevant marine policy and marine laws were stipulated in our country according to the international customs,the ICLOS rules and other oceans regulations,thus our marine legal system and policy system are preliminarily established,and we have achieved a great success in our ocean area. This paper discusses systematically our achievements in the area of marine laws and marine policy after new china was established. At the same time,this paper points out the main issues and the countermeasures,analyzing the necessity and the feasibility in our ocean development. Finally,the paper explains our ideas of the harmonized ocean from the perspective of the international law,and put forward the suggestions for the improvement of our marine laws and marine policy.
