On the System of Third Party Infringement of Creditor's Rights

第三人侵害债权制度是对传统民法理论的修正和补充,并对债的相对性等传统学说造成了一定冲击。该制度在英美法系国家以及德国、法国等国的司法实践中多有运用,但关于其适用及其适用要件尚存诸多争议。我国第三人侵害债权案件并不少见,但制度建设仍处于欠缺状态。为提出可供我国司法实践借鉴的立法选择建议,应在介绍第三人侵害债权制度的内涵及各国发展状况的基础上,着重探讨其在侵权法上适用的主要争议。

The system of third party infringement of creditor＇s rights is modification and supplement of traditional civil law theory. It gave an impact to the traditional theory of debt＇ s relativity. Many countries of Common law system and Germany and France exert this system in theirs judicial practice. But the system isn ＇t complete. This article focuses on the main controversies of the system＇s application, tables a proposal about China＇s legislation on the base of the introduction to the content and development of the system of third party infringement of creditor＇s rights.
