介绍了"软法"的概念,分析了其兴起的原因及其在公共治理领域中实施的困境,提出相应的措施:"软法"必须以构建和谐社会为价值目标,遵循宪法精神与法制原则,实现程序化、规范化和制度化。
The concept of soft law was introduced. The reasons of the initiation and the dilemma of soft law implementation in public administration were analyzed. Some countermeasures were proposed： The application of soft law must be based on the value goal of building a harmonious society, following the spirit of the Constitution and the rule of law to achieve programmed, standardized and institutionalized.
