论信息共享与版权保护的利益平衡

On Balance the Interests of Information Sharing and the Copyright Protection

网络的全球共享性与著作权专有性的矛盾,使知识共享与版权保护之间的冲突越来越激烈,网络著作权的侵权行为屡有发生。如何解决网络著作权中的复制权的界定,版权保护技术对公众学习自由权的限制,信息网络传播权的合理使用范围难以控制等问题,保持著作权人利益与公共利益之间的平衡,从健全网络服务者、使用者在保护著作权中的责任制度和对著作权的专有性进行合理限制两个方面提出对策。

The contradiction between the share of the global network and the proprietary of copyright makes the network copyright violations happen frequently and intensively in the course of knowledge-sharing and copyright protection. How to define the copyright network of reproduction, the relation between the copyright protection technology and the right of the public free study, how can we control the scope of information network to be disseminated right and etc. If we can solve the series of problems, we would base well the balance of the interests between the copyright holders and the public. The article provides some solutions to the above, such as establisbing a sound duty system of network service, and the restriction to the proprietary nature of copyright.
