摘要
我国现有的农村宅基地使用权转让制度已不符合当前农村经济社会发展的需要,具有很大的法律缺陷。有条件地允许农村宅基地使用权自由转让具有重要的法理价值和现实意义,在一定的法律规则构建下,农村宅基地使用权的有条件转让是实现农村宅基地使用权社会保障性与物权性的功能平衡、社会稳定和经济发展对接的最好桥梁。
The current transference system about the using rights of rural house land in China can' t meet the current needs of rural economic and social development, there are great legal defects. Conditional transference of the using rights of rural house land have important legal value and practical significance. With the construction of rule, the conditional transference of the using rights of rural house land is the best bridge of the functional balance between social security and property, is the best bridge of social stability and economic development.
