摘要
民主改革前,西藏的法律表现了地方法律和中央王朝立法两套并行的特点,随着中央政权对藏政策和立法的逐步成熟和深入,最终对西藏的官员任命、管理体制、活佛转世等进行了详细规定,从而实现了中央政权对西藏的统一立法。文章认为,梳理并总结这些法律制定的经过、内容、特点及启示,在今天复杂的国际局势下,对有效处理涉藏问题及宗教问题具有极大的现实意义。
Both local law and the Central government law were practiced in Tibet before the Democratic Reform in 1950s. As the Central Govemment regulated more policies to Tibet, such as the nomination of officials, the management system and the Lamas＇ Reincarnation System, the Central Government gradually realized the unified law in Tibet. It is of great significance to sort out and summarize the regulation process of these laws, the content, the characteristics and significance under the current complicated global situation for tackling with issues related to Tibet.
