法治视野下的城管综合执法体制研究

A Legal Perspective on Comprehensive Legal Enforcement in Urban Management

通过分析现行城管综合执法体制的现状,找出城管面临的现实困境与城管综合执法体制存在的主要问题,并以行政法治为视角进一步分析城管综合执法体制的混乱局面,剖析城管症结的核心。在此基础上,从法治视野对城管综合执法体制的改革路径和思维进行深入反思,揭示城管执法体制改革与我国行政管理体制改革存在的共通误区;并结合现代法治精神所要求的行政执法理念和先进的现代城市管理理念,对原城管工作理念进行重塑,并探索城管体制改革的新思路。

By analyzing the current comprehensive legal enforcement in urban management, this paper hopes to identify the difficulties faced by urban management officials and the major problems in the legal enforcement. From the perspective of the administrative law, the paper further analyses the chaotic situation and the major problems in the management. Based on this, an intensive study of the reformation in legal enforcement is done from the rule of law, and the common errors in the reformation and legal administration system are revealed. Finally, with reference to the present legal administration principles and the latest urban management philosophy, this paper proposes new ideas for the urban management principles and the reformation of management system.
