摘要
一直以来人们对受教育权的理解更多地是把它作为一项法律规定的权利,而忽略了受教育权与其他权利的内在区别,即作为受教育权核心要素的教育内涵。现代教育具有自由、民主和人权的内在规定要素,即"以人为目的"。因此,基于对"人是目的"教育内涵的理解,受教育权应具备自由、平等和人权等基本属性。
People have taken the right to education more as a legal right for so long and neglected the internal difference between the right to education and other rights, namely, the educational connotation as the core element of the right to education. The modern education includes the intrinsic regulated elements of freedom, democracy and human rights. In other words, it is people-oriented. Based on the understanding of education as people-oriented, the right to education should have the basic attributes of freedom, e quality and human right.
