摘要
反规避措施是反倾销措施的延伸与发展,是国际贸易摩擦与竞争不断激烈的表现。美国是第一个对中国出口产品提起反规避起诉的国家,2005年又首次对中国输美产品适用反规避法中的"产品轻微改变"与"产品后期开发"规则,且大有愈演愈烈的趋势。因此,观察与研究美国反规避法的来龙去脉,对中国出口产品跨越这一新贸易壁垒具有重要的现实意义。
Anti-circumvention measures are the extension and development of anti-dumping measures, resulting from the increasingly drastic conflicts and competition in international trade. America is the first country that lodged an anti-circumvention suit against China export products and cited the minor alternation and later development rules against China export products in 2005 and raged higher afterwards. Therefore, it is practically significant for us to focus on the ins and outs of U.S. anti-circumvention law with a view to help China export business to overstep the new trade barrier.
