A Study of Constitutional Philosophy Methodology

检视当下宪法学的研究成果,其方法论研究的空乏可窥见一斑。首先,学界侧重于对具体研究方法的探讨,而没有深入地研究关于方法的一般理论;其次,对方法论和具体的研究方法不加区分,在概念使用上界域模糊;再次,没有形成逻辑严密、构架科学、层次分明的方法论体系。为此,加强宪法哲学的方法论研究,明晰其研究对象、性质及功用,建构其科学体系,增强其实践理性,预见其发展走向,对澄清当下方法论研究中的困惑有着积极的指导意义。

An examination of constitutional philosophy research reveals the lack of methodology study, which is due to the fact that the academia firstly pays attention to the exploration of concrete methods other than makes profound study of general methodological theories, secondly makes no distinction between methodology and concrete methods and thus confuses their concepts in use, and thirdly fails to establish a methodology of close logic, scientific structure and clear coherence. It follows that it is of instructive significance in clarifying the confusion of the methodology study to enhance constitutional philosophy methodology study, clarify its objects, nature and function, form its scientific system, reinforce its practical rationality and predict the tendency of its development.
