On Legalization of Deliberative Democracy

协商民主是政治民主的重要实现形式之一,对扩大公民参与及理性对话有着积极的意义。中国社会主义协商民主在现阶段主要表现为中国共产党领导下的多党合作和政治协商制度,重在扩大票决民主及民主决策的基础。在依法治国背景下,协商民主的主体、内容及程序均应受宪法及相关法律(包括硬法和软法)的规制。协商民主存在的争端应当通过协商本身及法律机制来解决。

Deliberative democracy is one of the important ways to realize China＇s socialism democracy, which contributes a lot to promoting citizens to participate in rational dialogue. At present, Chinese socialism deliberate democracy features multi--party cooperation and political consultation system under the leadership of CCP, which focuses on expanding the foundation of democratic ballot and decision--making. In the background of ruling of law, the body, contents and procedures of deliberative democracy should be subject to the constitution and related laws （including hard law and soft law）. Disputes in the deliberative democracy should be resolved through consultation itself and legal mechanism.
