摘要
留置权是法定物权制度中不可或缺的一项,在《中华人民共和国民法通则》中即有明确规定,而其后的《中华人民共和国担保法》《中华人民共和国合同法》关于留置权概念的界定亦无出其右。1993年实施的《中华人民共和国海商法》虽未完全引入物权概念,但也规定和确立了以船舶所有权、抵押权、留置权为核心的船舶物权制度。随着《中华人民共和国物权法》于2007年10月1日实施,其中的留置权制度将对《中华人民共和国海商法》下的留置权制度产生影响。从《中华人民共和国物权法》对留置权概念的突破角度出发,分析《中华人民共和国物权法》施行后对《中华人民共和国海商法》留置权制度及海事司法实践可能产生的影响。
Lien is the indispensable right of the legal real system which is specified in General Principles of the Civil Law of the People's Republic of China. The concept of lien in Guarante Law of the People's Republic of China and Contract law of the People's Republic of China is of the same meaning. In 1993, though not fully implementing the maritime property concept, Maritime Code of the People's Republic of China introduced relevant regulations and established the ship ownership, mortgage, lien as the core of the ship real right system. With the implementation of Real Right Law of the People's Republic of China on 10.1,2007, the maritime lien system will be influenced by the lien system therein. From the breakthrough of the concept of lien, this article will analyze the possible impact on maritime lien system and maritime judicial practice after the enforcement of Real Right Law of the People's Republic of China.
