The Change and Evolution of China's Land Registration System

研究目的:通过对土地登记制度变迁的分析,揭示土地制度的演化方向。研究方法:文献资料法和制度经济学分析方法。研究结果:土地登记制度变迁有着其内在规律,在立法理念、管理体制和赔偿机制上还存在着缺陷。研究结论:制度演化要重视成果的共享,管理体制的统一和责任赔偿制度的建立。

By using the methods of literature data and institutional economics analysis,the paper argues that changes in the land registration system have its inherent laws;while there are still shortcomings in the aspects of legislative philosophy,management system and compensation mechanisms.Therefore,the paper puts forward that sharing results,a unified management system,as well as the establishment of liability and compensation system,must be paid more attentions to during the evolution of system.
