论法理学的功能定位与知识体系——兼论法理学的继承与创新

ON THE FUNCTION ORIENTATION AND KNOWLEDGE SYSTEM OF JURISPRUDENCE——Along with the inheritance and innovation of Jurisprudence

提出法理学的功能包括4个方面:确立法的本质、宗旨和价值取向;梳理法的发展脉络、演进规律和发展趋势;阐述法与社会(经济、政治、文化、民间规范)关系;阐述法律运行各环节的基本原则。只有这些明确的核心功能,才能避免把与法理学关联不大的杂乱知识塞入法理学,才能保持法理学对各种法律现象的解释力,以及对部门法学的指导性。

This paper points out the function of jurisprudence in 4 aspects： establishing the nature, purpose and value-orientation of legislation; making clear legislative developing thread, evolving laws and developing trend; expounding on the relationship between the law and society and the basic principles of various links in implementing the law. Only with a clear understanding of the functions and only on the basis of combining the law with social practice can we explain clearly various legal phenomena with jurisprudence and guide in the legislative sectors.
