摘要
发电权交易和排污权交易是促进节能减排的2种有效的市场手段,正在我国得到越来越多的关注与运用。从"权利"、"份额"2个层面,探讨了发电权、排污权及其交易的内涵;运用法学中财产权的有关理论,对发电权、排污权及其交易的法学属性进行了分析;从市场主体、市场空间、交易原理和交易的约束条件4个方面,对发电权交易和电力排污权交易进行了比较分析;深入研究了发电权交易和电力排污权交易之间的关系,指出发电权交易和电力排污权交易在交易流程、交易平台上是相互独立的,但二者在机制设计上有较为紧密的联系,应在电力排污权交易的机制设计中予以考虑。
Generation trading and emission trading are two effective market instruments that facilitate energy conservation and emission reduction, and are arousing more and more attention and practice in China. This paper firstly discussed the connotations of generation trading and emission trading from aspects of "right" and "quotient". Using the theory of property right, the paper then analyzed the legal attributes of generation trading and emission trading. Thereafter, the paper made a comparison between the two trading systems from 4 major aspectsmarket participant, market space, trading mechanism and trading constraints. At last, the mutual relation of these two trading systems was researched. And it is pointed out that the two trading systems are independent on trading process and trading platform, but have close interrelationship on mechanism design, which should be considered in the design of emission trading in power sector.
