论城中村改造中土地权属变更法律制度的完善

Legal System Improvement of Land Ownership Changes in the Transformation of Village in City

近年来,随着城市化建设进程的加快,城区范围不断扩大,原本在城市周边地区的村庄,如今已在区域位置上成为城区的组成部分,成为城市发展中的一道特殊景观——城中村。从完善《土地管理法》关于土地征用部分、保障征用补偿依法并及时到位、建立土地权属变更登记制度、完善土地使用监督检查机制、合理界定城中村土地的产权性质和流转制度及完善配套制度等方面提出了建议。

In recent years, with the accelerated process of urbanization, the city scope expanded, the original villages in the peri--urban areas have now become a part of the city, which is called ＂ villages in city＂. Some suggestions are proposed in this paper, they are： improving the land acquisition in the ＂ Land Management Law＂, securing legal and timely requisition compensation, establishing registration system of land ownership change, improving land-use supervision and inspection mechanism, defining reasonably the property rights and the circulation system of the village in city, and perfecting the supporting system.
